ECGT Directive (EU) 2024/825
The Empowering Consumers for the Green Transition Directive (ECGT, also called EmpCo) amends the Unfair Commercial Practices Directive (UCPD) and the Consumer Rights Directive. It is enforced through each country's consumer protection law and authorities.
- ✕ Generic claims: Words such as “eco-friendly”, “green”, “natural” or “environmentally friendly” without recognized excellent environmental performance.
- ✕ “Climate neutral” or “carbon-reduced” claims that rely on carbon offset programs.
- ✕ Sustainability labels not based on a certification scheme or set up by a public authority, including self-made brand badges.
- ✕ Whole-product claims: Stating a product is green when the claim only concerns one part, material, or packaging component.
- ✕ Presenting legal requirements as if they were a distinctive or voluntary feature of your offer.
- ✕ Future commitments: Statements like “net zero by 2030” without a clear, verifiable implementation plan with independent monitoring.
FTC Green Guides (16 CFR Part 260)
The Green Guides explain how the Federal Trade Commission views environmental marketing claims. They were last revised in 2012 and a new revision has been pending since 2022. The FTC enforces them under Section 5 of the FTC Act, which prohibits deceptive practices.
- • Avoid unqualified general claims: “Eco-friendly” or “green” on their own are very hard to substantiate.
- • Have evidence before you publish: Claims need competent and reliable scientific evidence.
- • Qualify clearly: Limitations must be clear, prominent and close to the claim.
- • Seals and certifications count as endorsements: They must not imply a broader benefit than the one certified.
- • Specific rules cover recyclable, compostable, degradable, “free of”, non-toxic, renewable and carbon offset claims.
